Booking Policy

1. Booking Conditions

A. All bookings must be cleared with Kaya Kweru (hereinafter referred to as the Resort) bookings department.

B. Accepted quotations will only be reserved for 5 working days without a deposit.

C. Bookings confirmations will only be given once 50 % deposit of the total accommodation fee has been received by the Resort. Alternate arrangements must be given in writing by the Resort.

D. The full amount agreed between any agent / guest and the Resort must be settled in full by no later than 15 days prior to the date of arrival. Failing to do so, the Resort may treat the booking as being a cancellation, thus forfeiting all/any deposits paid. Alternate arrangements must be given in writing by the Resort.


3. Payments

All payments will be made to the account details on the relative invoice that will be sent once your booking is made.


4. Cancellations

Cancellations of a booking must be made in writing, by the person signing this agreement and is not valid until the Resort receives such cancellations. If cancellations are done 31 days or more prior to arrival date then the deposit can be refunded in the form of vouchers for use at a later date.

In the event of cancellations 30 days or less then the following applies:

15 – 30 Days -50 % of deposit forfeited & a voucher will be issued in lieu of balance owing to client.

14 – 0 Days -100 % of deposit forfeited. Not negotiable.

Concessions will only be made for serious health reasons or sudden death in the family. In this case all such claims must be given in writing and must be validated.


5. Cancellations by the Resort

The Resort reserves the right, in any circumstances, to cancel the accommodation Agreements, but all such decisions will be given to the agent/s or guests in writing, stating valid reasons. In instances where the Resort cannot provide accommodation as agreed upon then the Resort will return to the agent/s or client all monies paid, which shall constitute the full extent of the Resorts liability to the agent/s or client, or the Resort may offer an alternate form of accommodation of comparable standards.


6. Authority at the Resort

The decision of Management or any duly authorized member of staff, employed at the Resort will make the final decision on matters concerning the Resort. No deductions or alterations can be made to any invoice submitted from the resort to the client, unless an agreement has been reached by both parties and such agreement is put in writing.


7. Exclusions from the Resort

The Resort shall not be responsible for or liable to any agent / client who commit an illegal or unlawful act whilst in Mozambique. The client may return to his apartment provided that all matters have been resolved with the legal authorities and all fines / charges have been paid in full. The Resort reserves it right to be excluded from any such payments. The Resort will also not refund any part of payment made while the client is in incarceration. Should the Client not return before the agreed check-out date, then the Resort reserves it right to retain all valuables in lieu of any outstanding payments due to the Resort by the client. Should there be no outstanding amount due by the client then the Resort will not be held accountable for any of the client’s belongings.


8. Arrivals and Departures

Check in times are strictly 12pm. The Resort cannot guarantee that the Client will be checked into the allocated room should they arrive before 12pm and will not be responsible for accommodating any early arrivals. The Resort will not be liable for any costs whatsoever incurred during this time.

Departure time is strictly 10am to allow the Resort clean up time for new arrivals. Later departures can be arranged but must first be confirmed with management from the Resort.


9. Declaration

The Client agrees to put, all valid passports, into safe holding with the Resort for the duration of the stay with the Resort. This is for security purposes only and will be handed over to the Client on departure or upon full settlement of all outstanding accounts. The Resort will take full responsibility for these passports during this time.


10. Emergency

The Resort will not be held responsible for any compensation to the agents / clients should the Resort be forced to close or cancel bookings due to force majeure, namely war, riot, civil strike, industrial dispute, terrorist activities, natural or nuclear disaster, fire, adverse weather conditions, or other external circumstances beyond the Resort’s control and by immediate repair will arrange to have the spare parts sent to us in the fastest possible manner. We will not be responsible for the cost of any accommodation other than that quoted for, and will not be liable for any airfares or repatriation costs whatsoever. We reserve the right to alter any schedules prepared accordingly in order to make up any time lost due to any unforeseen circumstances.


11. Right of Admission Reserved

The resort reserves it’s right to allow access to whom ever it chooses unless other arrangements have been made. If the Resort considers the client unsuitable to accommodate, it may in its absolute discretion to cancel such client’s booking or decline to accept any undertakings. The Resort can ask any client to leave if they prove to be excessively abusive to staff or any other client, of a violent or destructive nature, or a client that could prove to be threat to any other client or staff, a client that endangers himself or anyone else, a client that commits a crime, or if a client has not made full payment to the Resort.


12. Alterations & Liability

No employee or representative of the Resort has any right to alter, amend, waive, or vary any of these conditions nor to undertake any liability whatsoever on behalf of the Resort, unless such be in writing and signed by Management of the Resort.


13. Health

The client acknowledges being aware of the location of the Resort and hereby confirms that he or she is medically fit, in good health and is able to weather adverse conditions should they arise. Any client with a pre-existing medical condition or ill-ness must declare the true nature of such condition at the time of booking and make arrangements for the provision of any drug or any other cause of treatment which may be required during your stay at the Resort. Such a client would be required to provide a medical statement from a GP to confirm that they are for to travel. The Resort and its representatives will treat any information given to us with the strictest confidence.


14. Vaccinations

The Client must take all the necessary inoculations as are required or generally recommend in relation to the country to be visited. Make sure you have a valid Certificate of Vaccination stating all inoculations should it be required. The Resort does not accept any responsibility or cost whatsoever for a client being refused entry into the country due to incorrect or incomplete health documentation or vaccinations.


15. Baggage

All baggage and personal effects are at all times the clients risk and the Resort cannot accept any liability for any loss or damage caused.


16. Travel Documentation

It is the responsibility of the Client to be in possession of all valid travel documentation. Namely, passports, visa, permits, vehicle clearance, vaccination, or any other medical certificates required for traveling to the Resort. The resort does not accept responsibility for changes in border regulations in terms of visas or any other requirements. The Resort will inform the Client, on confirmation of booking, all current requirements. Thereafter it is the responsibility of the client to keep updated on any changes. The Resort cannot be held responsible for the failure of the Client to obtain the necessary visas or entry documentation. Should the Client be denied entry into the country due to incomplete or incorrect documentation, The Resort will not be liable for any costs of such delay or repatriation costs to the client or refund or transfer any deposits paid. Cancellation procedures as per no. 3 apply.


17. Insurance

Travel and Cancellation insurance is compulsory for all Clients. Before a Client commences a trip, he/she must arrange his/her own insurance with a reputable insurer, with protection for the full duration of his/her trip. The cover must include medical expense, personal injury, repatriation expenses, emergency rescue expenses, loss or damage to luggage and the expenses associated with cancellation or curtailment of trip. If a Client becomes ill, all hospital expenses, doctors’ fees and repatriation costs are that of the Client’s and the Resort shall not be liable for any part or refund of the trip.

18. Liability

Client bookings are accepted on the understanding that the Client appreciates the risks inherent in adventure travel and that the Client undertakes the trip or any adventure attached to the package offered by the Resort at the Clients own risk. The Client agrees that the Resort and its members of staff shall not be responsible for the loss or damage to property or injury or illness or loss of life or consequential damage which may occur from any cause whatsoever as long as the Resort does not act recklessly. The Client and his/her dependants, heirs, members, associates, employees, representative organizers, helpers or agents hereby indemnify and hold blameless the Resort and any part thereof of any claims whatsoever and howsoever arising and without limitation from any claim (including any consequential claim) arising from any delay, loss or damage to property or injury or illness or death arising from any cause whatsoever related to or occurring during the stay at the Resort, as long as the Resort does not act recklessly.


19. Information

Information given on the web site, brochures, leaflets and advertising is given in good faith by the Resort, and these are based on the latest information available at the date of publication. The Resort reserves the right to change any of the facilities or accommodation described without becoming liable for compensation or refund. While every endeavor is made to keep to the prices advertised, the company reserves the right to increase the fares at any time due to any unforeseen increases or exchange rate fluctuations to which it may be subjected. Increase/surcharges may be applied even after confirmation of bookings.


20. Photographic Material

Clients should be aware that the Resort and its representative may take photographs or films of the Clients while on holiday and the Resort reserves the right to use such material for any advertising or web site publication, brochure, or film production without obtaining consent and without payment to the Client.


21. Jurisdiction and Law

This contract shall be interpreted according to the laws of Mozambique.


22. Severability

In any part, term or provision of this contract is held to be illegal or unenforceable; it shall not affect the validity of enforceability of the remainder of the contract. Furthermore, if any covenants are held illegal or unenforceable by virtue of its scale extent or duration it shall remain valid and enforceable in such reduced scale, extent or duration as any court may decide as being the maximum scale, extent or duration permissible.
